Civil Litigation

Sandpoint Law P.C. engages in a broad range of civil litigation, focused primarily on business and real estate matters. The firm has represented plaintiffs and defendants in contract disputes, boundary line and easement issues, commercial and residential development grievances, probate and trust litigation, adverse possession cases, and construction defects matters.

Careful preparation and case management are the keys to successful litigation.

Partner Toby McLaughlin heads the litigation team. He brings the lawyers and paralegals together regularly to review cases and to insure that the firm is following all required timelines and procedures. Careful preparation and case management are the keys to successful litigation. While some lawyers are aggressive just for the sake of being “aggressive,” we believe in aggressively marshalling the facts and then finding the strongest legal theories that support a client’s case.

Most civil litigation is settled short of trial. In fact, today judges regularly order the parties into mediation. Consequently, Mr. McLaughlin and his legal team understand that there are two key ingredients to coming out ahead in settlement talks: first, assemble the strongest, most clearly articulated possible case and, second, communicate the case’s strengths and weaknesses to the client. Then the trial lawyer and client work as a well-informed team to achieve the best result possible.

If mediation fails, the Sandpoint Law litigation team goes to work to put on the most effective trial presentation possible.
